According to § 24a StGB
a person acts improperly, if the person is driving a vehicle in road traffic
even though his or her alcohol level exceeds 0,25 mg/l in the breath or
0,5 promille blood level or if an amount of alcohol is present that leeds
to such concentrations in breath or blood. The same holds for driving under
the influence of the following drugs: cannabis, heroin, morphine, cocaine,
amphetamine and designer amphetamine. In such cases, the regular consequence
is a revocation of the driving license and only if very special circumstances
that speak for the involved person can be brought up, the court or the
involved authorities can decide on a higher fine and not revoke the license.
Simply because the involved needs his license for work or privately is
not sufficient!
The first offense will be
followed by a revocation of the driving license for one month. In case
of a repetition, 3 months will apply.
