Everybody
who has legal capacity - what usually means aged 18 and above - can marry.
With approval of the "Familiengericht" (family court) it can be sufficient
if one partner is 18 and the other partner is at least 16 years of age.
If you do not have legal capacity, you will not be able to marry (§
1304 BGB. It is however not important wether one or both partner are under
caretaking.
